General Terms and Conditions (T&Cs) of WhatAGame

1. General Provisions

These Terms and Conditions (T&Cs) apply to all business relations between WhatAGame GmbH (hereinafter: WhatAGame) and its customers. Any inclusion of the customer’s own terms and conditions is hereby explicitly rejected, unless otherwise agreed in writing.

2. Formation of Contract

You can book appointments with us by phone, email, or via our website homepage. By submitting a booking for a desired date, you make a binding offer to enter into a contract. Acceptance generally takes place upon receipt of a confirmation email sent to the email address provided by you, confirming the receipt of your order.
Your order data, including these T&Cs, will be stored by us after the conclusion of the contract for the purpose of executing the contract.
For the alternative out-of-court settlement of disputes regarding online purchase and service contracts concluded between consumers and businesses, the European Commission has established an Online Dispute Resolution platform, accessible here: http://ec.europa.eu/consumers/odr/. Please note that we do not participate in dispute resolution proceedings before a consumer arbitration board.

For bookings made via telephone or email, a contract and binding booking only come into effect upon receipt of a booking confirmation sent to your email address. If you do not receive a confirmation email, please contact us immediately!

3. Dispatch and Payment Terms

Order confirmations are sent exclusively via email.
The purchase price for bookings made via the website is due immediately upon placing the order.
Payment processing for transactions using credit cards, PayPal, and immediate bank transfer is conducted in part via our payment partners Stripe and Klarna. You will be redirected accordingly.

Your confirmed order entitles you to entry and participation on the booked date and within the agreed duration/time slot.
To ensure a smooth event flow, all participants in the booked group size should arrive at WhatAGame 5 to 10 minutes prior to the booked start time. Unpunctual arrival will reduce the duration of the event accordingly, without entitlement to any refunds.

5. Liability

WhatAGame accepts no liability for any damages occurring before, during, or after the event on the indoor or outdoor premises of our location.

WhatAGame is entitled to withdraw from the contract. Notice of withdrawal may be declared up to 1 week prior to the scheduled event date at the latest. In cases of force majeure or other reasons that impair or prevent the execution of the game show (e.g., technical failures and damages of any kind, illness of the event host, etc.), WhatAGame may withdraw from the contract at any time. Any payments already made will be refunded immediately.

8. Cancellation Policy (Right of Withdrawal for Vouchers)

You have a statutory right of withdrawal for contracts regarding vouchers. Under this right, you may cancel this contract within fourteen days of purchasing a voucher without giving any reason. The cancellation period is fourteen days from the date of contract conclusion. We do not refund monetary value for vouchers once the voucher validity / redemption period has expired.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). To meet the cancellation deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the cancellation period expires.
If you withdraw from this contract, we shall reimburse all payments received from you immediately and no later than fourteen days from the day on which we received notification of your withdrawal. We will not charge you any fees for this reimbursement.
Exclusion of Right of Withdrawal for Scheduled Events: Contracts for the purchase of tickets or bookings in connection with leisure activities for which a specific date or period is provided are not subject to the statutory right of withdrawal (§ 312g para. 2 no. 9 BGB). This means that a standard two-week right of withdrawal and return does not apply to event time-slot bookings.

WhatAGame reserves the right to refuse entry to visitors or exclude them from an ongoing event if there is reason to believe that the individual(s) concerned may disrupt operations or harass other visitors or WhatAGame staff due to alcohol or drug consumption or for other reasons. In such cases, no refund of the ticket price or voucher value will be provided.
German law applies to all disputes arising from a contract concluded between WhatAGame and its customers, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For contracts concluded for a purpose that cannot be attributed to the professional or commercial activity of the beneficiary (consumer contracts), this choice of law applies only to the extent that it does not deprive the consumer of the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence.
The place of performance and exclusive jurisdiction (to the extent legally permissible) is the registered office of WhatAGame in Berlin, Germany.
